HEALTH & WELFARE LPA
A health and welfare LPA covers decisions about your health and welfare.
Your Attorney can make decisions about where you live, day-to-day care including your diet, what you wear and what medical treatment you receive.
If you wish your attorney can have the power to decide when medical treatment is to be withdrawn.
Your Attorney would need to be consulted by Social Services and the NHS about any proposals and treatment involving you.
Fact: A friend of ours had a serious illness. She had told her husband she didn’t want to die in hospital but wanted to stay at home and not to be resuscitated. She collapsed one night, the ambulance crew wanted to take her to hospital. Her husband explained her wishes. After a call to the hospital the ambulance crew informed the husband that they had a duty to take her to hospital and without a Lasting Power of Attorney for Health & Welfare he had no rights to make decisions for her. They took her to hospital where she died several hours later.
