Lasting Powers of Attorney Aren’t Just for the Elderly

When we hear “Lasting Power of Attorney” (LPA), it is easy to assume it is something only older people need. But this assumption can leave anyone, regardless of age, vulnerable in the face of life’s unpredictability. Accidents, serious illness, mental health issues, or even being out of the country can temporarily or permanently leave someone unable to make decisions. That is why LPAs are essential for everyone, not just the elderly.

What Is a Lasting Power of Attorney?

An LPA is a legal document that allows you to appoint someone you trust to make decisions on your behalf. There are two types:

  • Property and Financial Affairs LPA – Handles responsibilities such as paying bills, managing your bank accounts, and handling property transactions.
  • Health and Welfare LPA – Includes decisions about your care, daily routine, and medical treatment if you lose mental capacity.

The Risk of Not Having One

Without an LPA in place, your loved ones do not automatically have the right to step in. Even a spouse or parent cannot legally make financial or medical decisions for you without formal authority. Instead, they may have to apply for a Deputyship Order, which is a costly and time-consuming process that adds extra stress during an already difficult time. While creating an LPA typically costs a few hundred pounds, a deputyship can cost several thousand and includes ongoing annual fees. The court may also impose restrictions on the deputy’s powers, limiting flexibility.

Not Just for Crisis Situations

LPAs are not just for worst-case scenarios. A Property and Financial LPA can be used with your consent even if you still have capacity. For example, if you are overseas, unwell, or simply need help managing your day-to-day finances, your appointed attorney can step in to assist.
